With reference to my despatch No: 392 or the

3rd instant.

I have the honour to inform you that I have made no provision-

al appointment to the vacancy created in tas Executive Council

by the death of ur E.A. Hewett HM.Q. because I desire to urge

in this case an exception in the rule laid down in Paragraph

7 of Mr Chamberlain's despatch NO: 119 of the 29th of 10770 bay 1896, and to submit for favourable consideration the

name of Mr X.H. Sharp K.0. who is not a member of the

Legislative Council.

Before I prbosed to state my reasons for my recommendation

I wish to say that I question whether much weight is to be

attached to the possibility indicated in sir Matthew nathan's

Confidential Despatch of the 18th of January 1906 of the

appointment as an unofficial member of the Executive

Council of one who is not
